OFFICIAL SWEEPSTAKES RULES: October 10, 2024
PRELIMINARY INFORMATION: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. HalloWOW Sweepstakes (the “Sweepstakes”) will begin on October 10th, 2024 at 9 a.m. and ends on November 3, 2024 at 11:59 p.m. (“Sweepstakes Period”). All times referenced in the Sweepstakes refer to Eastern Time (“ET”). Odds of winning depend upon the number of eligible entries received. The Sweepstakes is subject to all applicable federal, state and local laws.
WHO CAN ENTER AND WIN: This Sweepstakes is open only to permanent, legal United States (“U.S.”) residents ages 18 years and older who physically reside in one of the 50 United States or the District of Columbia. Offer is void where prohibited by law.
WHO CANNOT ENTER AND WIN: Residents of Puerto Rico, Guam, the U.S. Virgin Islands and any other United States territories are not eligible to participate in this Sweepstakes. Officers, directors and employees of Tinkercast, LLC, their immediate families (spouses, parents (including step parents), children (including step children), siblings, in-laws, and any person living in the same households as these persons (whether such persons are related or not)), Tinkercast’s parent, affiliate, and subsidiary companies, judges of this contest, participating advertising and promotion agencies, and any other individual or entity involved in the development, administration, promotion or implementation of the Sweepstakes (and members of their immediate families and those living in the same household of each such persons (whether they are related or not)) (collectively, the “Sponsors”) are not eligible to enter and win the Sweepstakes.
HOW TO ENTER: During the Sweepstakes Period, upload a photo of a Wowzer dressed in any costume related to Wow in the World (“Sweepstakes Content”) to tinkercast.com/halloween. This could be a character, episode title, host, etc.
ALTERNATIVE METHOD OF ENTRY: To enter the Sweepstakes without uploading to tinkercast.com/halloween, you can send a printed copy of the photo entry to Tinkercast 41 Watchung Plaza Suite 312 Montclair, NJ 07042
All Entries become the property of the Sponsors and will not be acknowledged.
You may enter once a day during the Sweepstakes Period. Multiple Entries received from any person or Facebook account beyond this limit will void all such additional Entries. All entries must be received no later than Sunday November 3rd at 11:59 p.m. ET to be eligible for the Sweepstakes. Tinkercast LLC’s computer shall be the official timekeeper for all matters related to this Sweepstakes. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant who made a potentially winning entry, Sponsors reserve the right to deem that the entry was made by the registered subscriber of the email address submitted at the time of entry. Entry constitutes permission (except where prohibited by law) to use entrant’s name, Facebook user name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.
SWEEPSTAKES CONTENT GUIDELINES: By entering the Sweepstakes, (except where prohibited by law) each entrant agrees that Sponsor(s) and its promotional partners and third party marketing entities (if any) may use the Sweepstakes Content, name, likeness, voice, biographical data, video, and any other information contained in his or her entry in advertising, promotion, and marketing materials throughout the world, including on the Internet, without additional compensation, notice, review, or approval. Sweepstakes Content that does not meet the following “Sweepstakes Content Guidelines” are subject to disqualification in Sponsors’ sole discretion:
Except for materials that are in the public domain, the Sweepstakes Content, in its entirety, must be a single work of original material created by the entrant and suitable for presentation in a public forum. Entrant must be the sole owner of all copyright interests therein.
Sweepstakes Content must not have been submitted previously in any sweepstakes or contest of any kind or exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means previously.
Except for materials in the public domain, Sweepstakes Content must include only materials created by the entrant and must not infringe on the intellectual property rights of any other person or entity. Sponsors do not permit the infringement of others’ rights and any use of materials not original to the entrant is grounds for disqualification from the Sweepstakes. Entries that contain brand names, trademarks or company logos may be subject to disqualification.
Sweepstakes Content must not include material that: (a) is sexually explicit, indecent, obscene, violent, hateful, tortuous, defamatory, slanderous or libelous, (b) is derogatory or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, (c) invades the privacy or publicity rights of any person, living or deceased, (d) is unlawful, (e) is harmful to other users of the Promotion Website such as viruses, trojan horses or other technologies that could adversely impact the Sweepstakes; and/or (f) is disparaging to Sponsors or is inconsistent with the positive images and/or goodwill to which Sponsors wish to associate (at Sponsors’ sole and absolute discretion).
Each submission should not reveal any personal information about another individual, including another person’s address, phone number, e-mail address, credit card number or any information that may be used to track, contact or impersonate that individual.
Entrant must have permission from any individuals that appear or that are mentioned in their submission (e.g., family members, friends).
No background artwork should appear in the Sweepstakes Content unless it is an original work of the entrant. Any artwork, murals, etc. that can be seen in Sweepstakes Content must be created solely by the entrant or entrant must be the sole owner of all copyright interests therein.
Entrants must not submit a submission that if selected cannot be assigned to Sponsors as contemplated below.
PRIZE: Sponsors will award one (1) prize to eligible entrants who participated during the Sweepstakes Period (“Prize”). The Prize will consist of up to two “Wow-ified” Wow in the World Toy STEM kits from Wondery Kids and Thames & Kosmos, featuring decorations and a signed sticker from Mindy Thomas and Guy Raz. The Prize will be awarded “as is” with no warranty or guarantee, either express or implied by Sponsors.
The Estimated Retail Value (“ERV”) of each Prize is approximately US $70. Total value (“TV”) of all awarded Prizes is an aggregate value of approximately US $140. Actual Retail Value (“ARV”) of Prize may vary. Any difference between ERV and ARV will not be awarded.
Sponsors, in their sole discretion, will determine all details of Prize and reserve the right to substitute a similar Prize of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winners. Prize cannot be transferred by Winners or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed within a reasonable time after notification from Sponsors, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, at Sponsors’ sole discretion, an alternate Winner(s) may be selected from the remaining eligible entries.
WINNER SELECTION AND NOTIFICATION: On November 6th at 12:00 PM ET, one (1) winner will be selected at random by a representative of the Sponsors from among all eligible entries. Sponsors or one of their designees will make one (1) attempt to notify the winner by directly responding to the potential winner’s comment on the Post and asking him or her to direct message Sponsors at which time information will be collected for the sole purpose of delivering the Prize. The winner may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Sweepstakes Documents”) within five (5) days following the date of first attempted notification. Failure to comply with this deadline will result in disqualification, and, at Sponsor’s sole discretion an alternate winner may be selected from the remaining eligible entries. If the winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if his or her prize or prize notification is returned as undeliverable, the winner will be disqualified and time permitting, at Sponsor’s sole discretion, an alternate winner may be selected from the remaining eligible entries. Limit one (1) prize per family or household.
INDEMNIFICATION; USE OF WINNER’S NAME AND LIKENESS; AGREEMENT TO BE BOUND BY OFFICIAL RULES: By entering the Sweepstakes, each entrant agrees for himself or herself, and for his or her heirs, executors, and administrators (a) to release and hold harmless Sponsors, Facebook, and their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the or Sweepstakes or his or her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a winner, to the posting of such entrant’s name on www.facebook.com/wowintheworld and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes at Sponsors’ sole discretion.
DISQUALIFICATION: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law.
FORCE MAJEURE: The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.
DISCLAIMERS: Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error, including such error as may give an erroneous indication that a prize has been won; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned.
CANCELLATION, MODIFICATION, OR SUSPENSION: Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winner(s) in a random drawing from among all eligible, non-suspect entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted at www.facebook.com/wowintheworld.
PROHIBITION OF ENTRY: Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).
DISPUTES: Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, relating to, or connected with this Sweepstakes or Prize shall be resolved individually, without resort to any form of class action, and be governed by the laws of the State of New Jersey, without reference to its choice of law rules, governs this promotion and all aspects related thereto, and the forum and venue for any disputes shall be in Essex County, New Jersey. If the controversy or claim is not otherwise resolved through direct discussions or mediation, it shall then be resolved by final and binding arbitration administered by Judicial Arbitration and Mediation Services, Inc. (“JAMS”) in accordance with its streamlined arbitration rules and procedures or subsequent versions thereof (“JAMS Rules”). The JAMS rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in New Jersey. All proceedings brought pursuant to this paragraph will be conducted in Essex County, New Jersey. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and, in no event shall any party be entitled to recover attorneys’ fees, punitive, incidental, special, consequential, indirect or other damages, including without limitation lost profits, or costs of bringing the claim. Each entrant hereby waives all rights to claim such damages, all rights to have such damages multiplied or increased, and all rights to rescind this agreement or seek injunctive or any other equitable relief.
WINNER ANNOUNCEMENT: For a copy of the name of the prize winner or these Official Sweepstakes Rules, send a self-addressed, stamped envelope to #HalloWOW Sweepstakes, 41 Watchung Plaza Suite 312, Montclair, NJ 07042. All requests must be received no later than November 30, 2024, at 12:00 noon, ET.
